TERMS AND CONDITIONS To order a CDR Cross-Check report, please review and accept the CDR Cross-Check Terms and Conditions. Summary description. Thank you for your interest in The Acta Group’s (Acta®) Chemical Data Reporting (CDR) tool, CDR Cross-Check™. CDR Cross-Check utilizes the most recent information publicly available provided by the U.S. Environmental Protection Agency (EPA) (currently the 2024 lists) to identify whether all or some of your inventory of chemical substances are subject to CDR reporting under the Toxic Substances Control Act (TSCA) and, if so, at what reporting threshold. Specifically, CDR Cross-Check will identify whether your company’s chemicals are listed on the TSCA Inventory and, if so,
• whether they are listed as active or inactive;
• whether they are in an exempt category;
• whether they are subject to specific TSCA regulatory actions impacting reporting thresholds or exemption status in 2024; and
• what the 2024 reporting thresholds would be based on 2020 data.
Payment. The cost of the CDR Cross-Check is:
• $3 per chemical for the first 750 chemicals;
• $2 per chemical for additional chemicals over 750;
• Minimum fee of $400 applies; and
• 50% discount for repeat customers.
Payment must be received prior to uploading a customer’s information.
Customer understands that costs are calculated based on the number of chemicals specified at the time of the order. If more chemicals are provided in Customer’s submitted list than are specified in the order, Acta will run the number of chemicals from the order and exclude any additional chemicals. For example, if the order is for 200 substances and the template shows 220 chemicals listed, Acta will only provide output for 200 substances, per Customer’s order. Customer must place another order before Acta is able to process the request for the remaining 20 substances.
Customer also agrees that it will provide its list of chemicals via the Excel template provided by CDR Cross-Check and that chemicals must be listed by Chemical Abstracts Service Registry Number (CAS RN) or EPA Accession Number. Chemical names may also be provided, but they are not required.
It is imperative that the numerical chemical identifiers be exact. Please do not include leading zeros, and verify that numbers are not formatted as dates in the Excel file. Acta is not responsible for results, or lack of results, for chemical identifiers that are not properly formatted for submission or not valid.
Customer acknowledges that the output of CDR Cross-Check is currently based on the 2024 CDR lists posted by EPA as of
May 2024. This output is useful for purposes of conducting a
preliminary check of chemical substances in preparation for the 2024 CDR reporting. EPA will base CDR reporting requirements going forward, however, on the regulatory status of lists released prior to the beginning of the each CDR reporting cycle.
Acta's CDR Cross-Check will be updated at that time to include the updated lists. Customers that have already used CDR Cross-Check prior to the 2024 updates will receive a 50% discount to re-run any previous list processed by Acta.
Confidentiality. By continuing to the next step, it is understood and acknowledged that Customer will be providing certain information to Acta that Customer may consider confidential and/or proprietary and that Acta will take all needed steps to maintain that information as confidential and will not use it for any purpose other than for the requested evaluation through the CDR Cross-Check program. The confidentiality obligations in this Agreement shall survive and remain in full effect during and after the services hereunder have been performed and the work completed, unless and until Customer releases Acta from those obligations or makes the information publicly available.
Acta’s services. Acta will report promptly and professionally in writing to Customer the results of the CDR Cross-Check evaluation. Acta cannot be responsible for mistakes or omissions in content or format in Customer’s submission. In performing the evaluation and reporting, it is understood by Customer that Acta is not providing legal or consulting professional advice regarding the results or any actions that Customer should or need not take. Acta disclaims all warranties, express or implied, other than what is stated in this paragraph, and any liability on its part shall be limited to the amount paid by Customer or the cost of redoing the evaluation in question, as appropriate.
Print
